TERMS OF SERVICE
Welcome to www.goshule.com. These terms & conditions (“terms”) are a legal agreement between you and Bowin Brands in partnership with GoShule Ventures Limited that governs your access to and use of www.goshule.com and all subdomains thereof, including migration.goshule.com and any successor or replacement subdomains (the “site”), including any product ordering process and all related webpages, downloadable materials, information, photos, and other materials, documentation, blog posts, reviews, ratings, or content that appears on the site (“content”). References to “you” or “your” mean anyone who visits the site, makes a purchase on the site, accesses or downloads content, submits a review, or registers for an account. Your access to and use of the site, content, or your account is conditioned upon your acceptance of these terms and our privacy policy at https://www.goshule.com/privacy-policy, which is incorporated into these terms by this reference. Please read these terms and our privacy policy carefully before accessing or using the site. By accessing the site, you agree to be bound by these terms. If you do not agree with these terms, do not access or use the site or content, make a purchase, register for an account, submit a review, or click to indicate that you agree to these terms.
1. Changes to These Terms
We reserve the right to change these terms at any time, in our sole discretion. You should periodically review these terms for changes, and you can review the most current terms at any time at: https://www.goshule.com/terms-andconditions. The updated terms are binding on you as of the effective date indicated at the top of these terms. If you do not agree to updated terms, you should stop using the site before the effective date. Your continued use of the site after the effective date will constitute your acceptance of the updated terms.
2. Use of Website
You must be at least 13 years old to use our website. If you are under 13, you may only use the website with the consent and supervision of a parent or guardian. You agree to use the website for lawful purposes and in accordance with these Terms and Conditions.
3. Permitted Use; No Distribution
Except for the limited right to use the site and view the content, you may not download, copy, sell, print, rent, lease, issue, distribute, transmit, broadcast, modify, perform, display, transfer, upload, post, create derivative works of, exploit, sublicense, reverse-engineer, or otherwise use the site or content without express written permission from GoShule. You may only use the site for personal, non-commercial purposes. All products and content produced by GoShule are for personal, non-commercial use and may not be reproduced in any form unless otherwise expressly permitted by GoShule. No right, title or interest in or to any trademark, service mark, logo or trade name of GoShule or its licensors is granted under these terms. You may not remove any proprietary notices on the site or content, or attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management, access-control, or security system used as part of the site or content. You further agree not to interfere with the proper functioning of the site and not to use the content in a way that suggests you are a representative of GoShule. Any scraping, automated access, or other unauthorized access to and storage of content is prohibited. You may not use the site or content for any illegal purpose. Use of the content for any purpose other than what is described in this section is prohibited.
4. User Content
By submitting content (such as reviews, ratings, comments, feedback, or contributions) to our website, you grant GoShule a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media, including for GoShule's marketing and promotional purposes. You are solely responsible for the content you submit and must not infringe upon the rights of any third party, and must not submit content that is false, defamatory, misleading, or submitted on behalf of a school, business, or person without a genuine, disclosed basis for doing so. This license applies whether or not you choose to submit your review anonymously, and remains in effect even if you later change your display name to “Anonymous” or delete your account, except that GoShule will cease displaying your real name publicly upon such a request, consistent with Section 8 below.
5. Privacy and Data Protection
GoShule respects and is committed to protecting your privacy. When you visit the site, you authorize GoShule to automatically collect information about you and your use of the site and to use, transmit, process, and store this information in accordance with our privacy policy. Please review our privacy policy prior to using the site. GoShule processes personal data in accordance with Kenya's Data Protection Act, 2019, and applicable regulations issued by the Office of the Data Protection Commissioner (“ODPC”). Where you register using a third-party sign-in provider (such as Google), you authorize GoShule to receive and store the basic profile information (such as name and email address) shared by that provider, subject to that provider's own terms and privacy practices. You have the right, subject to applicable law, to request access to, correction of, or deletion of your personal data by contacting info@goshule.com. Where a review or account relates to a child (for example, a parent describing their child's experience at a school), GoShule requests that submitters avoid including unnecessary personal details about the child beyond what is relevant to the review.
6. Third Party Websites and Links
The site may contain links or references to third party websites (“linked sites”) that we think may be of interest to you. GoShule does not endorse or sponsor any linked sites, or the information, products, or services contained on any linked sites, and we have no control over linked sites or their content. Linked sites are governed by their own terms of use and privacy policies.
7. Account Registration
You may register for an account on the site (“account”) in order to access certain features including reviewing or following schools, updating school content, regularly receiving GoShule communication and uploading events. If you register for an account, you must provide GoShule with your current, complete, and accurate information, including your name, email address, and a password selected by you, or, where you register via a third-party sign-in provider, the information shared by that provider. Educational institutions are obliged to share more details to set up a profile on the platform. Your login and password may only be used by you, and you are responsible for keeping your user password confidential unless you request the GoShule team to manage the profile for you. You are responsible for all activity that occurs under your account, and you agree that GoShule may attribute all use of your account to you. Please notify us immediately if you suspect any unauthorized use of your account or any other breach of security. If GoShule has reason to believe that there is likely to be a breach of security or misuse of the site, we may require you to change your password or we may suspend your account. You agree to register only one account per person. Creating multiple accounts to submit multiple reviews, to circumvent any access, moderation, or rate-limiting mechanism, or to misrepresent your identity or relationship to a school is strictly prohibited and constitutes a material breach of these terms.
8. Reviews, Ratings, and Contribution-Based Access
8.1 Review Content Standards. When submitting a review, you must accurately disclose your relationship to the school (parent, teacher/staff, school administrator, or other), and, where applicable, provide honest and good-faith feedback based on genuine experience. GoShule reserves the right, in its sole discretion, to reject, edit for clarity or formatting, remove, or decline to publish any review, including reviews it reasonably believes to be fraudulent, defamatory, submitted by a person with no genuine connection to the school, or in violation of these terms. 8.2 Anonymity. You may choose to display your review publicly under your name or as “Anonymous.” GoShule retains your actual submitted identity internally for moderation, fraud-prevention, and legal purposes regardless of your public display choice, and may disclose that identity where required by law or legal process. You may request that a previously published review be changed from named to anonymous display by contacting GoShule, though the underlying record is retained as described above. 8.3 Contribution-Gated Access. Certain content on the site, including the full text of other users' reviews, may only be accessible to users who have at least one approved review associated with their account. Submitting a review does not by itself grant access; access is granted only once GoShule has approved the review, and access granted on this basis remains active for a period GoShule determines (currently twelve (12) months from approval), after which continued access may require submitting a new or updated review. GoShule may change, suspend, extend, or discontinue this access model, or introduce paid subscription tiers for the same or additional content or features, at any time and without liability to you. 8.4 No Verification Guarantee. GoShule may display indicators such as a recommendation count, a numeric or star rating, or a category rating breakdown based on approved user reviews. These indicators reflect the aggregated opinions of users who submitted reviews and are not a guarantee, endorsement, certification, or independent verification by GoShule of any school's quality, safety, suitability, or accuracy of the underlying claims, except where a review or listing is explicitly labeled by GoShule as independently verified.
9. Prohibited Conduct
In addition to the restrictions elsewhere in these terms, you agree not to: (a) create or use multiple accounts to submit duplicate, fraudulent, or fabricated reviews; (b) submit a review for a school with which you have no genuine relationship as a parent, student, staff member, or administrator; (c) use disposable, temporary, or falsified email addresses to register an account; (d) attempt to circumvent any rate-limiting, verification, or moderation mechanism on the site; or (e) offer, solicit, or accept payment or other consideration in exchange for submitting or removing a review. GoShule may suspend or terminate any account, revoke any access granted under Section 8.3, and remove any associated content, where it reasonably believes this section has been violated.
10. Payments and Subscriptions
Where GoShule offers paid features, listings, or subscriptions (which may be paused, introduced, or changed from time to time), payment may be collected via M-Pesa or other payment methods made available on the site. All fees are quoted in Kenyan Shillings unless stated otherwise and are non-refundable except where required by law or expressly stated at the time of purchase. GoShule is not responsible for delays or failures caused by third-party payment or telecommunications providers. If a payment is processed in error or a technical fault prevents delivery of a paid feature you were charged for, contact info@goshule.com for resolution.
11. Site Availability and Support
You may access the site when it is available. GoShule does not guarantee availability of the site or content and GoShule reserves the right to make changes to the site and content at any time and without notice. The site may occasionally be down for service, upgrades, maintenance, or for other reasons. To the maximum extent authorized under applicable law, GoShule reserves the right to change, remove, delete, restrict, block access to, or stop providing any or all the site at any time and without notice. GoShule has no obligation to provide any support in relation to the site, content, user content, or your account.
12. Disclaimer of Certain Damages
To the maximum extent permitted by applicable law, in no event will GoShule be liable for any consequential, special, incidental, indirect, or punitive damages; for loss of profits, business, goodwill, anticipated savings, or use; loss or corruption of data, confidential information, or other information; business interruption; personal injury; wrongful death; property damage; loss of privacy; failure to meet any duty of good faith or reasonable care; negligence; and any other pecuniary or other loss whatsoever, arising out of, based on, resulting from, or in any way related to these terms, the site, content, or your account, even if GoShule has been advised of the possibility of such damages. GoShule shall in no event be liable for any loss, damage, or expense of any kind resulting from any of its employees, representatives or salespersons rendering technical or other advice or representations in connection with the performance of any computer hardware, computer software, computer printers, media used by those printers, or any combinations thereof unless it is specifically contained in this agreement.
13. Indemnification
You hereby agree to defend, indemnify, and hold GoShule, its directors, officers, managers, members, affiliates, contractors, employees, agents, partners, suppliers, and licensors harmless and will keep them indemnified from any third party claims or demands, including reasonable attorneys' fees, relating to, arising from, or allegedly arising from (a) your use of the site and activities occurring under your account; (b) your use of any product purchased from GoShule; (c) our use of your user content; (d) any violation by you of these terms; (e) your violation of any other party's rights or applicable law; or (f) any review or content you submit, including any claim that it is false, defamatory, or infringing.
14. Notices
GoShule may give you all required notices (including legal process) by any lawful method, including by posting notices on the site or by sending notice to any email address you provide to GoShule. You agree to send GoShule notices by contacting us using the online forms provided on the “contact us” and “frequently asked questions” sections of the site, or by emailing info@goshule.com.
15. Reservation of Rights; Copyright and Trademark Notice
GoShule and its affiliates, licensors, and suppliers own the title, copyright, and other intellectual property rights in the site and content, including all text, photographs, videos, images, graphics, logos, button icons, downloads, templates, product photos, and linked documentation. GoShule's rights are protected by Kenya and international copyright laws and other intellectual property laws and treaty provisions.
16. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Before initiating any formal legal proceeding, you agree to first contact GoShule at info@goshule.com to attempt to resolve any dispute informally. If a dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the courts of Kenya, which shall have exclusive jurisdiction, or, where both parties agree, through arbitration seated in Nairobi in accordance with the Arbitration Act (Kenya).
17. Platform Role and Company Liability
The website acts as a venue for schools to set up their profiles and post events as well as individuals to post reviews, and GoShule does not screen or censor the school listings offered prior to publication, other than the review moderation described in Section 8. The company is not involved in the actual transaction between schools and individuals. Therefore, the company has no control over the quality, safety or legality of the profiles, events or other material posted, the truth or accuracy of the listings. You acknowledge and agree that you are solely responsible for the reviews or material placed by you on the website. Educational institutions are solely responsible for their postings on the website. GoShule is not responsible for any material posted on the website that may be offensive, harmful or inaccurate. Further, GoShule cannot and does not confirm that each user is who they claim to be. Schools that dispute the accuracy or fairness of a published review may contact GoShule at info@goshule.com with supporting information. GoShule will review such disputes at its sole discretion and may, but is not obligated to, remove, annotate, or request clarification of the disputed review. GoShule's decision not to remove a disputed review does not constitute an endorsement of its contents.
18. Accuracy of Material
The material may contain inaccuracies or typographical errors. The company makes no representations about the truthfulness, accuracy, reliability, completeness, or timeliness of the website or the material or material posted by users. The use of the website and the material and any reliance on material posted by other users is at your own risk. Changes are periodically made to the website and may be made at any time.
19. No Warranty on Technical Performance
The company does not warrant that the website will operate error-free or that the website and its server (or any software and materials accessible through the website) will be free of computer viruses or other harmful mechanisms. If your use of the website or the material results in the need for servicing or replacing equipment or data, the company is not responsible for those costs.
20. As-Is Basis; Disclaimer of Warranties
The website and material are provided on an as-is and as available basis without any warranties of any kind. The company, to the fullest extent permitted by Kenyan law, disclaims all warranties, whether express or implied, including without limitation, the warranty of merchantability, fitness for particular purpose, title and noninfringement. The company makes no warranties about the accuracy, reliability, completeness, or timeliness of the material, services, software, text, graphics, and links.
21. Termination
GoShule may suspend or terminate your account and access to the site at any time, with or without notice, for conduct that GoShule believes violates these terms, is harmful to other users, schools, or GoShule, or for any other reason at GoShule's sole discretion. You may stop using the site and request deletion of your account at any time by contacting info@goshule.com, subject to GoShule's data retention obligations under applicable law and Section 4 above. Sections 3, 4, 5, 9, 12, 13, 15, 16, and this Section 21 survives termination of your account.
